Liability Waiver and Release of Claims

Backyard Bogeys LLC, operating as Suburban Swings

This Liability Waiver and Release of Claims ("Waiver") is executed by the undersigned participant ("Participant") in favor of Backyard Bogeys LLC, doing business as Suburban Swings ("Company"), its owners, employees, contractors, agents, and representatives.

  1. Assumption of Risk

    The Participant understands and acknowledges that the use of golf simulators and golf equipment involves inherent risks, including but not limited to: - Bodily injury, including injury from errant or rebounding golf balls; - Property damage; - Accidents resulting from improper or careless use of the simulator bay. The Participant acknowledges that errant golf balls may strike surfaces, rebound, or otherwise behave unpredictably, creating a risk of injury to themselves and others.

  2. Required Competence and Safety Awareness

    The Participant understands that a reasonable level of competence is required to safely use the golf simulator, equipment, and surrounding area. The Participant agrees to follow all posted rules, verbal instructions, and safety guidelines provided by the Company. Failure to follow safety protocols or improper use of equipment may increase the risk of injury.

  3. Release of Liability

    The Participant hereby releases, discharges, and holds harmless the Company from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury, or harm that may be sustained while using the simulator, equipment, or services, whether caused by negligence or otherwise. This release applies to all forms of injury and damage, including but not limited to bodily injury and property damage.

  4. Indemnification

    The Participant agrees to indemnify and defend the Company against any claims brought by third parties arising from the Participant’s use of the simulator or equipment.

  5. Acknowledgment of Understanding

    By signing below, the Participant acknowledges that: - They have read and understood the terms of this Waiver; - They fully understand the risks associated with the activity; - They voluntarily agree to the terms without coercion.
